Happy Mammoth

After testing products from Happy Koala LLC, individually and dba Happy Mammoth, we found 2 products we allege to violate Proposition 65 in regards to heavy metal contamination. Below is the timeline of events of the case between ERC and Happy Mammoth.


NOTICE I

On July 12, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Happy Koala LLC, individually and dba Happy Mammoth.

In this action, ERC alleges that 2 specific products, manufactured, distributed, or sold by Happy Koala LLC, individually and dba Happy Mammoth, contain lead and mercury. Lead and mercury are chemicals listed under Proposition 65 as carcinogens and reproductive toxins, exposing consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Happy Mammoth NewSlim Complete Protein Meal Vanilla Bean - Lead, Mercury

  2. Happy Mammoth FitSlim SuperGreens Vanilla Bean - Lead


NOTICE II

On July 26, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Happy Koala LLC, individually and dba Happy Mammoth.

In this action, ERC alleges that 2 specific products, manufactured, distributed, or sold by Happy Koala LLC, individually and dba Happy Mammoth, contain Perfluorooctanoic Acid (PFOA). PFOA is a chemical listed under Proposition 65 as a carcinogen and a reproductive toxin, exposing consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Happy Mammoth NewSlim Complete Protein Meal Vanilla Bean - Perfluorooctanoic Acid (PFOA)

  2. Happy Mammoth FitSlim SuperGreens Vanilla Bean - Perfluorooctanoic Acid (PFOA)


SETTLEMENT

A settlement was reached on December 3, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Happy Mammoth, shall make a total payment of $55,000.00 to ERC.

CORRECTIVE ACTION

Beginning on the Effective Date, Happy Mammoth shall be permanently enjoined from manufacturing for sale in the State of California, "Distributing into the State of California," or directly selling in the State of California, any Covered Product that exposes a person to a "Daily Lead Exposure Level" of more than 0.5 micrograms of lead per day and/or a "Daily Mercury Exposure Level" of more than 0.3 micrograms of mercury per day and/or any detectable level of PFOA unless it meets the warning requirements under Section 3.2.
