Livingood Daily

After testing products from Livingood Daily, we found nine products that we allege to be in violation of Proposition 65 in regard to lead contamination. Below is the timeline of events of the case between ERC and Livingood Daily.


NOTICE I

On June 28, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Livingood Daily.

In this action, ERC alleges that four specific products, manufactured, distributed, or sold by Livingood Daily, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Livingood Daily Chocolate Collagen + Multi Plus + - Lead

  2. Livingood Daily Greens Unflavored - Lead

  3. Livingood Daily Lemon Lime Electrolytes + Energyze Plus + - Lead

  4. Livingood Daily Chocolate Plant Collagen Powder – Lead


NOTICE II

On July 12, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Livingood Daily.

In this action, ERC alleges that six specific products, manufactured, distributed, or sold by Livingood Daily, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Livingood Daily Vanilla Plant Collagen Powder - Lead

  2. Livingood Daily Original Greens Powder - Lead

  3. Livingood Daily Chocolate Greens + Superfoods Plus +- Lead

  4. Livingood Daily Greens Original – Lead

  5. Livingood Daily Berry Greens + Superfoods Plus + - Lead

  6. Livingood Daily Berry Frost Electrolytes + Energyze - Lead


NOTICE III

On July 26, 2024, the Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Livingood Daily.

In this action, ERC alleges that three specific products, manufactured, distributed, or sold by Livingood Daily, contain Perfluorooctanoic Acid (PFOA). PFOA is a chemical listed under Proposition 65 as a carcinogen and reproductive toxin and exposes consumers to levels requiring a Proposition 65 warning. 

The products under investigation are:

  1. Livingood Daily Chocolate Plant Collagen Powder - Perfluorooctanoic Acid (PFOA)

  2. Livingood Daily Vanilla Collagen + Dr. Livingood Coffee - Perfluorooctanoic Acid (PFOA)

  3. Livingood Daily Vanilla Plant Collagen Powder - Perfluorooctanoic Acid (PFOA)


SETTLEMENT

A settlement was reached on October 7, 2024. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, DLG Holdings, LLC, individually and dba Livingood Daily Livingood Practice Management, Inc., shall make a total payment of $50,000.00

CORRECTIVE ACTION

Beginning thirty (30) days from the Effective Date (the “Compliance Date”), Livingood Daily shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product which exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or any detectible level of PFOA per day unless it meets the warning requirements under Section 3.2.
