Well Beyond, LLC
After testing some products from Well Beyond, LLC, we found three products we alleged to be in violation of Proposition 65 in regards to lead amounts. Below is the timeline of events of the case between ERC and Well Beyond, LLC.
NOTICE
On April 11, 2019, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Well Beyond, LLC.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Well Beyond, LLC, contain lead and/or cadmium, chemicals listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to lead at a level requiring a Proposition 65 warning. All products below allegedly contain lead, the product in italics also allegedly contains cadmium.
These products are:
1. Beyond Shake Balanced Nutrition Meal Replacement Salted Caramel Vanilla
2. Beyond Shake High-Antioxidant Meal Replacement Dark Chocolate
3. Beyond Healthy Chocolate Xobiotic Squares
NOTICE II
On February 20, 2020, Environmental Research Center filed a second Notice of Violation of California Law Proposition 65, against Well Beyond, LLC.
In this action, ERC alleges that three specific additional products manufactured, distributed, or sold by Well Beyond, LLC, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and exposes consumers to lead at a level requiring a Proposition 65 warning.
These products are:
1. Beyond Xe Energy Multiplier Proprietary Blend of Superfruits + Cacao
2. Beyond Healthy Chocolate Nuggets Dark Chocolate With Acai and Blueberry
3. Beyond Healthy Chocolate X Power Squares Extreme Dark Chocolate With Acai & Blueberry
SETTLEMENT
A settlement was reached on October 19, 2020. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Well Beyond, LLC shall make a total payment of $80,000.00 to ERC.
