Tranont - Settled
After testing products from Tranont, we found two products we allege to be in violation of Proposition 65 in regards to lead contamination. Below is the timeline of events of the case between ERC and Tranont.
NOTICE
On September 1, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Tranont.
In this action, ERC alleges that two specific products manufactured, distributed, or sold by Tranont, contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Tranont Nourish GOS Prebiotic Meal Replacement, Coconut Cream
2. Tranont Nourish GOS Prebiotic Meal Replacement, Brownie Batter
NOTICE II
On September 15, 2022 Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against Tranont.
In this action, ERC alleges that three specific products manufactured, distributed, or sold by Tranont, contain lead and merucry, chemicals listed under Proposition 65 as carcinogens and reproductive toxins, and expose consumers to levels requiring a Proposition 65 warning.
The products under investigation are:
1. Tranont Boost
2. Tranont Glow Advanced Type 1 Collagen with Superfood Antioxidant Support, Strawberry Banana
3. Tranont Glow Advanced Type 1 Collagen with Superfood Antioxidant Support, Orange Cream
SETTLEMENT
A settlement was reached on March 23, 2023. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Tranont shall make a total payment of $95,000.00 to ERC.
CORRECTIVE ACTION
Beginning on the Effective Date, Tranont shall be permanently enjoined from manufacturing for sale in the State of California, “Distributing into the State of California,” or directly selling in the State of California, any Covered Product that exposes a person to a “Daily Lead Exposure Level” of more than 0.5 micrograms of lead per day and/or “Daily Mercury Exposure Level” of more than 0.3 micrograms of mercury per day unless it meets the warning requirements under Section 3.2. However, if the California Office of Environmental Health Hazard Assessment establishes a “safe harbor” Maximum Allowable Dose Level (“MADL”) for either mercury or lead that is higher than 0.5 micrograms of lead per day for lead or .3 micrograms of mercury per day for mercury, then those MADLs shall substitute for the levels identified in this Section 3.1.
