Perficio Networks, Inc and Vivacity, Inc.
After testing some products from YOR Health, we found four products we alleged to be in violation of Proposition 65 in regards to lead amounts. Below is the timeline of events of the case between ERC and Perficio Networks, Inc, and Vivacity, Inc.
NOTICE
On April 9, 2020, Environmental Research Center filed a Notice of Violation of California Law Proposition 65, against KWB Incorporated, Perficio Networks, Inc., and Vivacity, Inc., all dba YOR Health.
In this action, ERC alleges that four specific products manufactured, distributed, or sold by YOR Health contain lead, a chemical listed under Proposition 65 as a carcinogen and reproductive toxin, and exposes consumers to lead at a level requiring a Proposition 65 warning.
These products are:
YOR Health YOR Supergreens
YOR Health YOR Shake Chocolate
YOR Health YOR Shake Vanilla
YOR Health YOR Essential Vitamin
SETTLEMENT
A settlement was reached on August 11, 2020. In full satisfaction of all potential civil penalties, additional settlement payments, attorney's fees, and costs, Perficio Networks, Inc. and Vivacity, Inc. shall make a total payment of $37,500.00 to ERC.
